These Terms of Service (“Terms”) govern your access to and use of the TML platform, including our website, services, and applications (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

1. Overview
TML is an online marketplace that connects freelance professionals (“Sellers”) with clients or businesses (“Buyers”) seeking freelance services. Sellers create service listings (“Gigs”), and Buyers can browse, order, and review these Gigs.
2. Eligibility
You must be at least 18 years old and capable of entering into legally binding contracts to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.
3. Account Registration
- Users must create an account to access the features of the Platform.
- You are responsible for safeguarding your account credentials.
- TML reserves the right to suspend or terminate accounts for any violation of these Terms.
4. User Responsibilities
- You agree not to violate any applicable laws or third-party rights while using the Platform.
- You may not post false, misleading, or fraudulent content.
- You are solely responsible for any content you upload or transmit through the Platform.
5. Orders and Payments
For Buyers:
- You agree to pay the total price for services purchased, including any applicable taxes and service fees.
- Payments are made through TML’s secure payment system.
- Refunds and cancellations are governed by our Refund Policy.
For Sellers:
- Earnings will be credited to your account after order completion, subject to a clearance period.
- Sellers are responsible for paying any taxes on their earnings.
- TML may charge service fees on completed orders.
6. Cancellations and Refunds
- Cancellations may be requested by either party in accordance with our Cancellation Policy.
- TML reserves the right to mediate disputes and issue refunds at our sole discretion.
7. Intellectual Property
- Sellers grant Buyers a license to use the delivered work for its intended purpose, unless otherwise specified.
- TML does not claim ownership of user-generated content, but you grant us a worldwide, royalty-free license to use it for promotional and operational purposes.
8. Prohibited Conduct
Users may not:
- Use bots or unauthorized tools to interact with the Platform.
- Harass, abuse, or harm others.
- Post or transmit harmful, obscene, or illegal content.
- Offer or accept payments outside the Platform (“off-platform transactions”).
Violations may result in account suspension or legal action.
9. Disclaimer of Warranties
TML provides the Platform on an “as is” and “as available” basis. We do not guarantee that the Platform will be error-free, secure, or uninterrupted.
10. Limitation of Liability
To the maximum extent permitted by law, TML shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Platform.
11. Indemnification
You agree to indemnify and hold harmless TML, its affiliates, and employees from any claims or liabilities arising from your use of the Platform or breach of these Terms.
12. Modifications to Terms
We reserve the right to change these Terms at any time. We will notify users of material changes, and continued use of the Platform constitutes acceptance of the revised Terms.
13. Termination
TML may suspend or terminate your account at any time for breach of these Terms or for any reason at our discretion. Upon termination, you must cease all use of the Platform.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Trinidad and Tobago, without regard to conflict of law principles.
